Some of you older readers will remember a cease-and-desist letter I got from some company called Dixona Trucking. We more-or-less agreed that I should ignore it because the lawsuit threat was beyond ludicrous. Anyhow, I thought that was the end of it but I was contacted by my domain host a couple days back. Apparently he filed a complaint through their complaint system (he can’t go after me directly because my domain is anonymous). They said that they were looking into it.
Long story short, the whole situation is absolutely ridiculous. But you know what? Dumber things have happened than my identity getting disclosed in this mess. I decided that I would save everyone some time and go through and change all references of Dixona to my new home state name, Delosa. Dixona was obviously a play on “Dixie”. Delosa is apropos nothing except my appreciation of Thucydides’ History of the Peloponnesian War.
While I was going through it, I changed the suburb I was raised in from Tangramayne to Mayne to avoid getting traffic for people looking for Bard’s Tale cheats.

After looking back through, “dixona trucking” and “dixona transport” don’t even show up as results on a google search, save for this site.
And it’s going to take weeks for google’s cache to clear the search result, so likely mr. idiot is going to continue being an idiot anyways. He seems like the type – after all, he doesn’t even understand how google works.
He doesn’t even show up in a yellow pages search for his company.

Have you ever contacted him in person, via phone call? Sometimes it seems these misunderstandings can be cleared up much easier with just a person-to-person conversation.
People tend to get very official and self-important when trading emails and letter back and forth, and especially talking through lawyers. I’m convinced a great number of all legal disputes could be resolved with a simple conversation between the two parties involved. There are nuances in human interaction that can never be used or picked up on when communicating via the written word.
Maybe you could help him understand what you’re writing is a fictional, stylized account of your life and that the name you use is generic enough to, in no way, impact his business. Especially since he doesn’t even have a website or web presence at all. He’s probably just worried about business and that “interweb” thingy everyone talks about…

Ok… this is silly beyond silly.
According to Florida’s register of trademarked business entities (http://www.sunbiz.org/index.html), I have run every conceivable search around the names “Dixona”, “Dixona Transport”, and “Dixona Trucking.”
The result? Bupkus.
There is no “Dixona Transport” in St. Petersburg, Florida, or anywhere else in Florida, either by Entity name, Trademark name, or Fictitious Name registry.
There is no LLC registered as owned by one Michael Jeffries.
The closest thing I was able to find was a “Dixon Auto Transport”, owned not by Michael Jeffries at all, and existing not on the SW coast of the Florida peninsula in St. Petersburg, but rather on the NE side of the state in Jacksonville.
Michael Jeffries is either an incompetent boob, or some form of a scam artist. I urge you to give the full information so his company – if they actually exist – can have this explained properly to them.

I’m not convinced that it isn’t some pimply-faced sixteen year old that wants to use Dixona as a handle or something (Julie ran into this several years back). Maybe he intends to start a company but before he does he wants all of his ducks in a row (though if that were the case he might have to pay me for the rights to the name!). At the end of the day I really don’t care enough to solve this little mystery.
Besides, the way I figure it if there is a company or it ever does get off the ground, if someone googles it they’ll still run into my site because of the posts involving the name change.
Hopefully no one will try to claim exclusive use of “Estacado.”
Fortunately, they’d have to get down pretty far on a google of Estacado before getting to me and they’d have to be willing to sue a lot of companies.
